hopes to sell DOT on ‘I-95 radio’

A
lively radio presentation giving details of what’s in the Fayetteville area. A
compelling female voice touting the 18 golf courses and 350 restaurants in the
area as just the drawing cards in the community. That’s what the Fayetteville
Area Convention and Visitors Bureau wants broadcast around the clock on
Interstate 95.
Preliminary
plans for the broadcasts are complete, and the next step is to see if the state
Department of Transportation will help pay for the network.
Bureau
directors heard the prototype broadcast Thursday when they met in the Crown
Coliseum board room.
Called
Fayetteville Area Visitor Orientation Radio (FAVOR), the broadcasts would be
24-hour AM transmissions giving motorists descriptions of restaurants and
hotels and information on attractions in the Cape Fear region.
“I
have received the proposal, but have not reviewed it yet,” Lyndo Tippett of
Fayetteville, a state Board of Transportation member, said Thursday. “I expect
to get to that soon.”
Bureau
President Doug Traub said the advantages for DOT would be the capability of
sending emergency messages on traffic conditions or approaching hurricanes.
Under
the proposal, four 10-watt radio transmitters would be installed on I-95 and
Business 95 to broadcast within a 12-mile radius.
The
system is expected to cost about $90,000.
The
bureau does not plan to sell advertising for the broadcasts. Messages will be
between one and three minutes long.
The
bureau also elected new officers. They are Gene Ammons Sr., chairman; Subodh
Thakur, vice chairman; Henry Holt, treasurer; and Cliff Strassenburg,
secretary. Thakur and Strassenburg were re-elected to their present offices.
Ammons
served on the board from 1984 to 1990 and returned in 1997. He is the owner of
the Quality Inn Ambassador, Econo Lodge I-95, Fairfield Inn I-95 and Sleep Inn
I-95.
Holt,
who has been a member of the board since 1990, is president of Holt Oil Co.
Thakur
is owner of the Villager Lodge and the Shangri La hotel in Spring Lake.
Strassenburg is Cumberland County manager.

was past president of Y.L.I. and of the St. Stanislaus School Mother's
Club.
She is
survived by her husband, William Ansel Byrd of Aptos; daughter Sandra
Byrd
Ciccarelli of Modesto; sons Gary Alan Byrd and Timothy Alan Byrd, both of
Modesto,
and Larry Alan Byrd of Waterford; 15 grandchildren; and four
great-grandchildren.

Fairfield
Inn planned off I-95’s Exit 49

A
14th hotel is planned at Exit 49 off Interstate 95 in Fayetteville.
Gene
S. Ammons Jr. expects to start building the Fairfield Inn by Marriott in early
summer. It could open in early 1998.
The
hotel will be on Cedar Creek Road next to the Sleep Inn, another of Ammons’
hotels at the exit. He also owns the nearby Econo Lodge and the Quality Inn
Ambassador on U.S. 301 South.
The
Fairfield Inn will contain between 60 and 63 rooms, which will each rent for
between $59 and $79 a night. The three-story hotel will contain an indoor pool
and meeting space for 40. It will have no restaurant.
Well-known
name
Ammons
said he sought the Fairfield franchise for the exit because the Marriott name
is so well-known among travelers.
“Some
of it is preventive maintenance,” he said. “A Marriott is the only thing that
Exit 49 doesn’t have. I figured if I didn’t do it somebody else would. I might
as well take money out of my pocket than have somebody else do it.
The
project is the latest in a hotel building boom, both at the 16-year-old exit
and in the larger Fayetteville area. Three hotels have opened at Exit 49 in the
past two years. Another, a 55-room Best Western, is under construction and
expected to open this summer.
Two
more hotels, both catering to extended-stay travelers, are being built near the
city’s heart -- a 120-room Extended Stay America on Owen Drive and a 144-room
Suburban Lodge on Bragg Boulevard.
Some
hotel managers have said the market will be at or past saturation when all the
new properties open.

Ammons cut the rates at the Econo Lodge I-95, Sleep Inn of Fayetteville and Quality
Inn Ambassador to $45 from $54 as refugees filled all three hotels.
Some
other hotels weren’t full, said Doug Traub, president of the Fayetteville Area
Convention and Visitors Bureau.
“It
was nothing like it was during Fran,” he said. But, he added, Fayetteville has
at least 600 more rooms than it did a couple of years ago. “(Hotel) people were
calling us telling us they had rooms, but we told them we weren’t full.
The
CVB had about a dozen calls asking for rooms. Traub speculated most people had been
forced to leave coastal regions in years past, so they just called the hotels
direct.
A
number of those calls went to the Ammons properties. Those hotels were full by
late Wednesday afternoon, Ammons said.
Cutting
the rates will cost him some money, he said. “But it was the right thing to do.

A
room glut squeezes hotels.
New
hotels keep opening in Cumberland County, just like new stores and restaurants.
And as in the retail and restaurant industry, the additional competition has
created problems for some hotels already here.
Probably
every hotel in the area has suffered a bit because of the additional
competition, said Gene S. Ammons, chairman of the Fayetteville Area Convention
and Visitors Bureau and owner of four local hotels.
Fayetteville
is overbuilt, he said. But that’s life in the cyclical hotel business --
booming business when rooms are too few and not-so-hot business when rooms are
too plentiful.
It’s
not awful for most hotels in Fayetteville except, perhaps, those that haven’t
spent money on maintaining themselves, Ammons said.
In
fact, he looks at the bright side. “It’s really better for the industry because
it weeds out the properties that do not maintain themselves,” he said.
Ammons
predicts 1999 will be about like 1998 for local hoteliers -- flat, though the
U.S. Open in Pinehurst in June will be a bright spot, filling hotels for miles
around, even the lesser properties.
“The
year 2000, things will be looking up,” Ammons said. He said he believes
business will improve by then even though several more chains are said to be
looking at opening hotels here.

Conventions
bode well for business
The
numbers look good for area tourism in the new year

People
in the tourism business have a cheerful outlook about the prospects for the
Fayetteville area in 1999. Gene Ammons Jr. points to an increase in bus traffic
at three hotels his company runs near Exit 49 of Interstate 95.
The
traffic is up 300 percent. Another indicator: 26 conventions are coming to the
area.
‘‘Our
motor-coach bookings are triple what they were last year,’’ said Ammons Jr.,
who is president of Sterling Hospitality Services.
The company
owns and operates Sleep Inn Fayetteville, Econo Lodge I-95 and Fairfield Inn,
all near Exit 49.
‘‘And
... when these bookings are up, leisure travel increases also,’’ he said.
Prospects
are also good for downtown hotel occupancy, according to Roger Razaki, manager
of the Radisson Prince Charles Hotel.
‘‘We
are an historic hotel and that, with downtown development and the attractions
at the (Crown) Coliseum will mean a very good year for us,’’ he said.

RALEIGH
-- Witnesses said Monday that Cumberland County District Court Judge Jim Ammons
took unusual steps in a court case on behalf of a political supporter. The case involved a bad-check charge brought
by Fayetteville businessman Keith Allison, a friend of Ammons. The witnesses,
testifying before the Judicial Standards Commission, said Ammons took part in
scheduling the case, instructed a prosecutor to phone Allison to let him know
the case was being called and later criticized the District Attorney's Office
for dismissing the case when it was on appeal.
The commission is reviewing Ammons' actions in two other matters. He is
accused of holding a special session of court for an acquaintance who wanted to
clear up a series of traffic tickets and of having a woman jailed in a
child-custody case. The cases in dispute occurred in 1993 and 1994. The panel heard only from prosecution
witnesses Monday. Ammons is expected to present evidence today. In an opening
statement, James Maxwell, Ammons' lawyer, said the judge had done nothing
unusual in any of the cases. The
Judicial Standards Commission could recommend that Ammons be reprimanded or
removed from office or it could choose to take no action. Final action in cases
of judicial misconduct is up to the state Supreme Court. The check case involved a check for $1,000
that Laura Anne Miller gave to Allison for a rent payment. Allison contended
the check was bad. Miller said she stopped payment on the check because of a
dispute over a security deposit. The
case was scheduled for Jan. 7, 1993, and Miller was granted a delay until Jan.
21 to hire a lawyer. Ammons issued an order for Miller's arrest after she
failed to appear for the second court date. She was arrested on Feb. 17 that
year and a magistrate scheduled the case for the next day, according to
testimony. John McCauley, a former
assistant district attorney, testified that Miller approached him when her name
wasn't called in court. ``Judge Ammons told me that he had the case, and he
indicated it would be called last,'' McCauley told the commission. McCauley
said Ammons handed him a slip of paper with a phone number and had him call
Allison. According to testimony,
Miller's lawyer, Gene Russ, asked to remove himself from the case when he found
that Allison, a friend of his, was involved. Ammons agreed, but denied Miller's
request to delay the case. McCauley said Ammons participated in questioning
Miller, at one point asking: ``Why did you write this bad check?'' Ammons found Miller guilty and ordered her
to pay $1,060 -- the amount of the check and court costs -- or go to jail.
Miller appealed the case, and Ammons set bond at $1,060. Witnesses testified
that Ammons typically refuses to allow more than one delay in a worthless-check
case and that the fine and bond were typical. But McCauley said he was bothered
by the case. ``I was not comfortable
with my participation,'' McCauley said. ``I thought it reflected poorly on my
office and on me. I just felt uncomfortable with the way it was handled.'' The District Attorney's Office dismissed the
case on the grounds that it was a civil matter. Maxwell, Ammons' lawyer, acknowledged
that the judge advised Allison to contact the prosecutors' office when Allison
asked if anything could be done to reinstate the case. Assistant District Attorney Claire Hill
testified that District Attorney Ed Grannis reinstated the charge after Allison
met with her but later dismissed it again. She said that as Allison waited
outside for his meeting, Ammons came into a conference room, asked why Allison
was being kept waiting and expressed disagreement with the dismissal. ``He said something about the charge being
valid even though stop payment was indicated on the check,'' Hill said.
Incident
recounted- A lawyer and another assistant district attorney who were in the
conference room testified that Ammons and prosecutors differed over whether a
stopped check could be handled as a criminal matter. ``He indicated that he was concerned and
upset because the district attorney had dismissed a worthless-check charge on
his friend,'' said Assistant District Attorney Margaret Russ. ``He thought it was
wrong ... He wanted his friend helped.''
Under questioning by Maxwell, Hill said that Ammons did not ask for any
special treatment and did not contact her about the case again. But she said:
``I felt uncomfortable about it.'' In
the traffic case, witnesses said Ammons held a special session of court for
Darrell Eugene Garner, who wanted to resolve several old tickets to get his
license back. Ammons first asked Judge John Hair to hear the case, but Hair was
almost finished with court that day, witnesses said. Ammons had known Garner
from about 10 years before when Garner worked in a clothing store that Ammons
shopped in occasionally. Maxwell said
that Ammons did nothing unusual, that Ammons was assigned to the court handling
overflow cases that day and that he took guilty pleas in Garner's case and in
another traffic case. Garner testified
that when he first contacted Ammons, the judge advised him to get a lawyer.
Garner said that when he called Ammons later, the judge said he would see what
he could do for him. Garner said Ammons helped him pull his traffic record from
a public computer in the clerk's office and took him to Hair's courtroom before
hearing the case himself. Christie
Sexton, a former assistant district attorney, testified that she was abruptly
called into court to handle the case. She said she was concerned that officers
in the cases weren't present. Under questioning from Maxwell, she acknowledged
that it was not unusual for officers to be absent when guilty pleas are taken
in traffic court. She said that at one point, Garner referred to Ammons as
``Jim.'' In the custody case, Maxwell
said, it was never the judge's intent that Jean Ann King Byrd be jailed but he
issued an order for arrest after she defied a previous order to return children
to their father. Byrd was jailed overnight. Maxwell said Ammons sought to get
Byrd released as soon as he found she had been jailed.

hours before the Judicial Standards Commission, which has accused him of
misconduct. The panel's complaint
against Ammons says he improperly pushed the worthless check case on behalf of
businessman Keith Allison, a friend and political supporter. The complaint also
accuses him of holding a special session of court for an acquaintance and of
improperly signing an order that landed a mother in jail in a custody
dispute. Ammons admitted Tuesday that he
erred in signing the order in the custody dispute. The allegations against Ammons involve cases
in 1993 and 1994. ``I've seen these
instances taken out of context and piled upon by innuendo and rumor around the
courthouse,'' Ammons said. ``This is my first opportunity to tell my side, and
I appreciate the opportunity.'' Ammons
is expected to continue testifying today as Senior Deputy Attorney General
Thomas Farrell, who is prosecuting the case, begins his cross examination.
Ammons is to be the last witness. The
commission will make a recommendation on his case to the State Supreme Court,
which will decide what action -- if any -- to take against Ammons. He could be
reprimanded or removed from the bench.
In his testimony Tuesday, Ammons said he hears cases almost daily
involving people he knows.
``If
I recused myself every time I knew somebody, I wouldn't do a whole lot of
work,'' Ammons said.
Informal
conversation-He said his only assistance to Allison in the worthless check case
was finding out why prosecutors dismissed the case when it was on appeal after
Ammons had found the defendant, Laura Ann Miller, guilty. Witnesses testified
Monday that Ammons had been involved in scheduling the case and chided members
of the district attorney's staff about the dismissal. Ammons said he walked into the prosecutors'
office by coincidence when the case was being discussed. He said there was an
informal conversation about whether a stopped check case could be prosecuted as
a bad check. Ammons described the conversation as light-hearted. He said he
defended his verdict but took no other action.
He
said he looked into the matter as a courtesy to a county resident. ``I thought that he deserved to know what
happened,'' Ammons said. ``I probably was a little concerned about the
perception that the dismissal was my fault.''
Ammons
said his verdict and sentence in the case were similar to his judgments in
thousands of other worthless check cases.
In the traffic cases, Ammons said he told Darrell Garner how he could
get the cases reopened to get his license restored. He said that reopening
cases to take guilty pleas was a common practice in District Court. Ammons said he helped Garner pull his traffic
record, but could not get District Court Judge John Hair to add the cases to
the end of the calendar that day. Ammons, who was assigned a courtroom for any
overflow cases that day, opened court to take guilty pleas in the Garner case
and at least one other case, according to testimony. ``He was a member of the public,'' Ammons
said. ``This was nothing unusual or extraordinary. I've done it hundreds of
times at least.'' Ammons said he hadn't
seen Garner for about 10 years, since Garner worked in a clothing store where
Ammons occasionally shopped. In the
custody case, Ammons said he signed an order calling for the arrest of Jean Ann
King Byrd after she failed to obey an order to return her children to their
father. Ammons said he signed the order without a hearing. He said he took the
word of the father's lawyer, Michael Boose, that Byrd's lawyer, Gene Russ, did
not object. Byrd was held overnight in the Cumberland County Jail.
Character
witnesses-``I should not have signed an order ordering that she be incarcerated
without a hearing,'' Ammons said. Byrd
was later found guilty of contempt of court and sentenced to the time she had
served. Ammons presented about a dozen
character witnesses. Eight other people stood to say they supported Ammons but
did not testify. Witnesses included District Attorney Ed Grannis, Spring Lake
Police Chief Gil Campbell and other lawyers, police officers and community
leaders. They said Ammons is a man of integrity and a tough judge known for
fairness and consistency.

RALEIGH
-- Cumberland County District Court Judge Jim Ammons said Wednesday that he
wishes he had never heard of three cases that are the subject of misconduct
allegations. ``If I could go back in
time, I wouldn't have handled any of these three matters,'' Ammons said. ``I
would have taken vacation on those days.''
But Ammons told the Judicial Standards Commission that he didn't mean to
do anything wrong. The commission held a hearing this week to determine whether
the judge is guilty of willful misconduct.Ammons is accused of giving special
treatment to a friend pursuing a worthless check case, holding a special
session of traffic court for an acquaintance and improperly jailing a woman in
a custody dispute. The hearing concluded
Wednesday. There is no deadline for the commission to make a recommendation to
the state Supreme Court on what kind of action -- if any -- to take against
Ammons. He could be reprimanded or removed from the bench, but the prosecutor
who handled the case against him said the second possibility is unlikely.
Senior
Deputy Attorney General William Farrell said that Supreme Court rulings in
cases similar to Ammons' indicate that his case is probably not serious enough
to result in removal. ``This does not rise to the level of cases where we have
seen willful misconduct found by the Supreme Court,'' the prosecutor said. In his closing argument, Ammons' lawyer,
James Maxwell of Durham, said the judge's judicial career was being threatened
by a case built on ``innuendo'' ``rumor'' and ``absolutely perjured
testimony.'' He said that some witnesses were motivated by political
opposition. Ammons testified that in the
worthless check case and the traffic tickets case, he provided help that he
would have given any citizen.
Heated
arguments-In the check case, Ammons rendered the verdicts the facts demanded,
Maxwell said. In the traffic case, Ammons did a public service, he
said.``Probably more good was done to the justice system by allowing a citizen
to come in and handle the matter,''Maxwell said. Farrell questioned what the
public would think of Ammons' friends getting such help. He noted
testimony,denied by Ammons, that the judge demanded that prosecutors reinstate
the worthless check case after they dismissed it. ``I don't contend to you for
one minute that Judge Ammons had malice in his heart,''Farrell said. ``The
question is an appearance of impropriety." In the custody case, Ammons
acknowledged that his order -- which resulted in a mother being jailed when she
wouldn't turn her children over to their father--violated procedure in civil
contempt of court cases. He said he should not have issued the order without a
hearing. Farrell said Ammons had ignored the law in the custody case. Maxwell
acknowledged the mistake, but the woman in jail had defied orders to turn over
her children to her husband.

Reprimand

The
state Judicial Standards Commission has recommended that Cumberland County
District Court Judge Jim Ammons be censured. In an order filed Wednesday, the commission
said Ammons has violated the Code of Judicial Conduct. The recommendation now
goes to the state Supreme Court, which will decide whether Ammons will be
censured. Censure is a formal criticism
or public reprimand. It has no effect on a judge's responsibilities, retirement
or tenure in office. The charges which
led to the commission's order stem from three incidents in 1993 and 1994. The complaint says Ammons ordered a trial on
a worthless check case involving a friend, Keith Allison, even though it was
not on a court calendar; held a special traffic court session for an
acquaintance, Darrell Eugene Garner; and ordered a woman named Jean Ann King
Byrd arrested in a custody dispute.
Ammons issued a written statement on Thursday. He said that because his
case is still pending, it would be inappropriate to comment further. ``Since I knew my conduct in each of these
incidences was in fact completely fair and proper, I may not have been
sufficiently sensitive to the possibility that others may have perceived
certain actions differently and more negatively. ``In the future, I intend to continue to
preside in a courtroom where everyone receives treatment that is in fact fair
and to make an even greater effort to make sure this actual fairness is
combined with a perception of fairness.''
In the case involving the worthless check issued to Allison, the
commission held that Ammons violated a canon that says: ``A judge should not
allow his family, social or other relationships to influence his judicial
conduct or judgment. He should not lend the prestige of his office to advance
the private interests of others, nor should he convey or permit others to
convey the impression that they are in a special position to influence him. He
should not testify voluntarily as a character witness.'' In the matter involving the arrest of Mrs.
Byrd, the commission found that Ammons violated parts of two canons. The first says: ``A judge should respect and
comply with the law and should conduct himself at all times in a manner that
promotes public confidence in the integrity and impartiality of the
judiciary.'' The second says: ``A judge
should be faithful to the law and maintain professional competence in it. He
should be unswayed by partisan interests, public clamor, or fear of
criticism.'' Ammons said, ``In the Byrd
matter, I admitted that I made an honest mistake that judges often make and are
normally appealed to a higher court and corrected. There was never an issue of
favoritism in this case. I was honestly trying to do what was best for the
children involved. I regret that the law through inadvertence was applied
incorrectly.'' The commission took no
action in the traffic case involving Garner.
``Unfortunately, over the course of making thousands of judicial
decisions every year, almost all trial judges will misapply the law at some
time,'' Ammons said. ``I do not plan to make this mistake again and I will
redouble my efforts to minimize erroneous rulings on matters of law. ``I intend to use this as I am sure it was
intended, as constructive criticism to help me grow and improve and be a better
judge.''

District
Court Judge Jim Ammons filed Monday for the Superior Court judgeship left
vacant by the recent retirement of Coy Brewer Jr. Ammons is the fourth
candidate to enter the race.
Ammons-Filing for the job will end at noon Tuesday at the N.C. Board of
Elections in Raleigh. Already in the
race are District Court Judge Robert Stiehl and Fayetteville lawyers John Tyson
and Hank Finch. Both Ammons and Stiehl
had already filed for re-election to their District Court seats, and their
names apparently will be on both ballots in the November general election. Ammons, 42, a Fayetteville native, has been a
District Court judge since 1988. He was appointed by Gov. Jim Martin to fill
the unexpired term of Lacy Hair when he retired. Ammons was an assistant district attorney for
seven years prior to appointment as judge. As judge, he has presided in
domestic, traffic, misdemeanor criminal and juvenile cases. Ammons graduated from Reid Ross High School.
He received an associate in arts degree at Louisburg College in 1975. He
received his undergraduate degree from the University of North Carolina in 1977
and got his law degree at UNC School of Law in 1980. Ammons is a 1989 graduate of the National
Judicial College. He has received special training as a judge in domestic
violence and traffic safety and has been a certified juvenile court judge since
1995. He and his wife, Sandy, have two
children.

Over
the years, Jim Ammons spent a lot of time in Superior Court as a
prosecutor. Now, he’ll be spending time
there as the judge. Surrounded by dozens
of friends, courthouse officials and family members, Ammons took the oath of
office Wednesday from E. Lynn Johnson, senior resident Superior Court
judge. Ammons, who is 43, became the
fourth Superior Court judge in the county, replacing Coy E. Brewer Jr., who
retired. Ammons is to serve the
remainder of Brewer’s term and will stand for re-election in 2002.
Could
hold court soon-Ammons could hold court as soon as Dec. 7 in Fayetteville. He
said his plan is to watch Johnson in court, perhaps take some pleas or preside
over a trial. “I will be guided by what Judge Johnson wants me to do,’’ Ammons
said after the ceremony. Superior Court

said Ammons is the 19th Superior Court judge to be based in Fayetteville since
the state’s first Superior Court judges were named in 1798. Officials say that
for many years, Fayetteville was served by only one judge. It wasn’t until 1967
that a second judgeship was approved. And
Ammons made history in another way, too: He is the first judge in North
Carolina history to be elected to the District Court and the Superior Court on
the same day. Judge Jack Thompson mentioned that fact during his introduction
of Ammons. The crowd laughed, as Ammons looked at the floor and shook his head.
Gov. Jim Hunt will appoint someone to fill Ammons’ District Court seat. Ammons is the son of the late James Floyd
Ammons Sr., a prominent Fayetteville lawyer who died in 1992. “Floyd would have
been very proud to have been here to witness these proceedings,’’ Thompson
said. As Ammons took the oath, his
daughter, Sarah, 3, sat on his feet and looked up, while Ammons’ wife, Sandy,
kept a firm hand on their son, Jamie, 5.
Afterward, Ammons thanked God, those present, and those who couldn’t be
there for the ceremony. "I want to
thank my family and Sandy’s family for standing by me in all these elections,’’
he said. "And I want to thank Mom and Dad for raising me and taking care
of me for 36 years and I want to thank Sandy for taking over at that
point." And I want to promise
each and every one of you that I will do my best to do this job and to do it
right.’’

Jim Ammons regarded the defendant before him. The man had been released from
jail on a Friday and had promptly gotten into trouble over the weekend. The defendant was laughing. Ammons was not. JIM AMMONS

The hearse, with a dead deer in the back, had been found in Marlboro County,
S.C. I’m setting his bond at $1 million,
cash,’’ Ammons said. More than a hundred
pairs of eyes widened and groans swept the room.
There
are two reasons I am doing this,’’ Ammons said. “There will be a substantial
penalty for leaving this jurisdiction, and I want to let anyone who reviews
this bond to know how seriously I took this.’’
Turning to the defendant, Ammons said: "You are extremely
dangerous.’’ And to the police who were standing nearby: "I hope you all
don’t have any more problems with him for a while.’’ It was one of the last
cases in the last week that Ammons held District Court before moving up to the
Superior Court bench. And it was
classic criminal court in Courtroom 2-C, where there is usually standing room
only -- almost anything is likely to happen and almost everything already
has. And it was classic Ammons. His
nickname is “The Hammer,’’ which he insists was given to him by Highway Patrol
troopers after they saw a gavel on his campaign signs. He is a judge who law
enforcement officers swear by and more than one defense lawyer has sworn at.
His sometimes quick, often blunt, assessments of cases have made people laugh,
made people angry or made people think.
Before
the week was out, Ammons would face down a defendant who said that because he
was from an invisible empire, he was not required to wear his seat belt. Ammons
found him guilty anyway. In court on
this day, two men faced Ammons to plead guilty to soliciting prostitutes who
turned out to be police officers. The men got deferred prosecution, which means
that if they successfully complete a year of probation, the charges will be
dismissed. "I’ve got some good news
for both of you,’’ Ammons said. “Part of the good news is that you are going to
get a second chance, after doing something dumb like this. The other good news
is that these prostitutes were not prostitutes; they were police officers. If
they had been prostitutes, you would have AIDS right now. There are a couple of
hundred prostitutes in town. Know how many have AIDS?’’ The two shook their heads. Most of them,’’
Ammons said. Tough and fiery-Ammons was
a tough prosecutor and fiery trial lawyer.
But some defense lawyers said that when Ammons left the District
Attorney’s Office for his District Court judgeship, he just moved the
prosecutor’s table up to the bench. They
said Ammons also has a tendency to keep score, to help his political
supporters. And they said that he has a
tendency to lecture people in court.
Another view from some lawyers is that Ammons has always treated them
fairly, that their clients have never complained about him and that they have
never contributed a dime to his campaigns.
One said that he believes Ammons is conscientious, but that he has a tendency
to get angry. Ammons knows about the
criticisms. He said a small segment of lawyers don’t like the way he conducts
himself as a judge. He said they have a tendency to blow things out of
proportion, to the point that their stories bear little resemblance to what
happened in court. I try each case
individually and I try to be fair to everybody and I do what my heart and my
mind tell me to do, based on the law and the evidence,’’ Ammons said. ‘‘And I
don’t see anything wrong with letting your heart be a part of the equation.’’ Ammons said political contributions do not
affect his decisions in court. He pointed out that in the last campaign, 90
percent of his contributions came from such sources as law enforcement
officers, teachers and business people, not lawyers. And when Ammons hears the charge that he
favors the state, he points to his childhood as the son of the late James Floyd
Ammons Sr. "I was raised by a man
who was a defense attorney, and I worked in his office from the time I was 14
until I became an assistant district attorney, working to defend people,’’
Ammons said. “I believe it is a noble calling to be a defense attorney. I
happen to feel like I was a better prosecutor than a defense lawyer. "But as a judge, I try to be fair and evenhanded
with everybody. I don’t take a lot of excuses for criminal behavior." He said that while everyone deserves a second
chance, there are limits. "I don’t
believe that repeated attempts at trying to get somebody’s attention by doing
things short of going to jail is beneficial to anybody,’’ Ammons said.
Controversy-Controversy
has followed Ammons during his career. He has faced opposition in three of his
last races: Bill Davis in 1990, David Hasty in 1994, Jerome Person in
1998. But perhaps the biggest challenge
came in August 1996, when the state Supreme Court voted to censure Ammons. The
high court acted on the recommendation of the Judicial Standards Commission,
which oversees judges in North Carolina. The commission said Ammons had
violated the Code of Judicial Conduct with actions that brought his office into
disrepute. The commission said that in
1993, Ammons allowed a trial on a worthless-check case involving a friend,
Keith Allison, even though it was not on a court calendar, and ordered a woman,
Jean Ann King Byrd, arrested in a custody dispute. Ammons said the whole thing made him a better
judge.
"I
have learned a lot from that episode,’’ he said. “I have learned to be not so
trustful of people. I have learned that even if you have good motives, you can
still make a mistake. It made me a better judge; it made me remember that we’re
all only human, that as long as we can survive a mistake and learn from a
mistake, it is not an all-bad thing. Some good can come from it.’’
Votes
still follow-Even with the censure, Ammons won 39 percent of the vote against
fellow District Court Judge Robert Stiehl and lawyers John Tyson, Hank Finch
and Debra Price in the Nov. 3 election.
Soon after the election and again when he was sworn in on Wednesday, he
said he was in shock. He said the task
before him seems daunting, and he hopes to start slow and to develop a
philosophy as a Superior Court judge, the same way he did in District
Court. He has started by taking a class
from Judge E. Lynn Johnson and Trial Court Administrator Linda Priest on
structured sentencing. He’ll be taking another round of classes at the
Institute of Government in Chapel Hill.
"I was given some advice by a judge, who told me not to back away
from something that you think that you can’t handle,’’ Ammons said. “He told me
to go slowly, go deliberately, do it by the law and by the book; and the next
time you run up on something like that, you can do it because you made yourself
do it.’’ When he isn’t at the
courthouse, Ammons goes to White Lake or to Myrtle Beach, where his family and
his wife’s family have summer places.
Sometimes, he’ll try to get in a round of golf, or go target shooting at
a range. And the rumor that he once used
an opponent’s campaign poster for target practice? Never been proven, he said.
But
Ammons said that the thing that he tries to do most is to spend time with his
children, Jamie, 5, and Sarah, 3, and his wife Sandy. It was during one of
those times that he found what would be an omen of his campaign. Ammons, his
wife and children went out for a quick lunch at a Chinese restaurant. Everybody
got fortune cookies, but Ammons had to rush off to a campaign function. It
wasn’t until several days later that Ammons opened his cookie and looked at the
fortune, which is now framed on his office wall. It says: "It’s better to be the hammer
than the anvil.’’

Lynn was diagnosed with breast cancer in 1988
and died of the disease on 10/9/1993 at 2:30 P.M.
